Ⅱ. Regulatory Provisions on Survey and Loss Adjustement
(Ⅰ) According to the regulations of the Banking Insurance Regulatory Commission, only those who hold the Practice Certificate of Insurance Survey and Loss Adjustment Practitioners can engage in insurance survey and loss adjustment activities. You may ask our personnel to present the practice certificate, and you may inquire about the status of the personnel's certificatethrough the Insurance Intermediary Regulatory Information System of the Banking Insurance Regulatory Commission (http://iir.circ.gov.cn).
(Ⅱ) According to the Asset Assessment Law and theProvisions on the Supervision and Administration of Insurance Adjusters, the insurance adjusters and their practitioners enjoy the following rights:
To request the client to provide relevant ownership credentials, financial accounting information and other information, as well as necessary assistance for the implementation of fair evaluation procedures;
To consult with relevant state organs or other organizations the documents, credentials and materials required for carrying out their business according to law;
To reject the illegal interference of the client or other organizations or individuals in the survey and loss adjustment behavior and results;
To sign the survey and loss adjustment report according to law;
Other rights prescribed by laws and administrative regulations.
(Ⅲ) According to the Asset Assessment Law and theProvisions on the Supervision and Administration of Insurance Adjusters, the insurance adjusters and their practitioners shall perform the following obligations:
To be honest and trustworthy, to engage in business independently, objectively and impartially according to law;
To comply with assessment rules, perform investigation duties, independently analyze and estimate, diligently and prudently engage in business;
To complete the required continuing education, maintain and improve the professional competence;
To check and verify the authenticity, accuracy and completeness of relevant documents, credentials and information applied in the survey and loss adjustment activities;
To keep state secrets, business secrets and individual privacy that are acquired in the survey and loss adjustment activities;
To avoid the situation where there is an interest involving the client or other relevant parties and the object of the survey and loss adjustment;
To accept the self-regulatory management of self-regulatory organizations in insurance intermediary industry and fulfill the obligations stipulated in the articles of association.
Other obligations stipulated in laws and administrative regulations.
Ⅲ. Complaints and Disputes Settlement
(Ⅰ) If you find that our company's survey and loss adjustment practitioners have acted against your legitimate rights and interests, please pay attention to retaining written evidence and other evidence.
